Cashback Scheme
To participate in the Cashback Scheme, you need to have a registered account on UPI platform.
Participation in this Scheme is valid from 26th November 2018 commencing at 00:01 hours till 31st March 2025 culminating at 23:59 hours.
We reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this Scheme or any part thereof including the T&C at our sole discretion at any time during its validity as may be required including in view of business exigencies and/or changes by a regulatory authority and/or statutory changes and/or any reasons beyond our control and the same shall be binding on you.
Cashback will be credited to your bank account through UPI gateway within a period of 48 hours of every successful eligible transaction on an automated basis.
If you provide any incorrect information or conceal/withhold any information from us with intent to wrongfully gain under this Scheme, you are liable to be automatically disqualified from participating in it. Such act of your providing incorrect information or concealing/withholding any information, including without limitation incorrect declaration of information relating to name, age, identity, address, mobile number, domicile, etc. or dispute with us, shall entitle us to disqualify you without any further intimation.
In cases of any fraudulent/suspicious transaction, we solely reserve the right to revoke the transaction.
We reserve right to take appropriate legal action against you if involved in illegal/unauthorized activity.
The cashback under this Scheme is neither assignable nor transferable under any circumstances.
UPI T&Cs shall apply for transfers through UPI. Our responsibility ceases once payment has been credited to your bank account through UPI and we shall not be responsible in any way for the utilisation of your bank balance thereafter.
Data Storage and Use
By using this App, you consent to your information being stored in our or our service providers' servers/ data base.
You hereby irrevocably authorize us to use your data/information gathered during and/or after the Scheme. By using this App, you confirm to waive the applicability of rules and regulations of the National Do Not Call Registry and agree to receive updates and promotional messages/ SMS/ emails/ calls for our current and future schemes.
You understand and agree that your acceptance of the cashback, constitutes your grant of permission to us to use your name, photograph, preferences (likes and dislikes), voice and comments for advertising and promotional purposes in any media worldwide, only for the purposes of advertising and trade, without any additional compensation whatsoever to you. You hereby provide your irrevocable consent for sharing/submission of your personal information to us, and subsequent use by us of such information for lawful purposes as per our discretion.
Limitations to Use
Except as expressly permitted here or the other provisions of this disclaimer, you must not download any material from our App or save any such material on your mobile or print any material from our App.
You must not reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the information received through this App to anyone, including but not limited to others in the same company or organisation, without the express prior written consent from us.
You must not:
use our App in any way or take any action that causes, or may cause, damage to the App or impairment of the performance, availability or accessibility of the App;
use our App in any way that is unlawful, illegal, fraudulent or harmful;
use our App to copy, store, host, transmit, send, use, publish or distribute any material which consists of or is linked to any spyware, mobile virus or other malicious software.
Intellectual Property Rights
SC and Supercircle are registered trademarks of Super Circle Auto Limited. All rights to use these trademarks are reserved.
All other trademarks, names of makes and models of vehicles/engines and names of companies/associations appearing on this App are the property of their respective owners, including, in some instances, Supercircle. We have no claim whatsoever over them.
Limited Liability
We do not warrant or represent:
the completeness or accuracy of the information published on our App; or
that the material on the App is up to date.
We reserve the right to discontinue or alter any or all of our App services, and to stop publishing our App, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in this disclaimer, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any App services, or if we stop publishing the App.
Indemnification
You agree to indemnify and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt and expenses (including but not limited to attorney's fees), whether direct or consequential, arising from your use of this App and Cashback Scheme.
We or our respective affiliates shall not be responsible for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by you or any third party, in connection with this App and Scheme.
All incidental costs, taxes or levies related to the cashback, if any, shall be exclusively borne by you, including but not limited to logistics, TDS, gift tax, insurance and any other taxes applicable by the Central, State or Municipal governments.
You understand and agree that we, our owners and affiliates, shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), to you and/or any third party, directly or indirectly, by use or non-use of the cashback money.
We shall not be responsible for any claims from you or any third party arising out of any failure(s) which is beyond our reasonable control. Without limiting the generality of the foregoing, we shall not be responsible for any claims arising out of technical failures before, during or after the completion of the Scheme.
You hereby agree and undertake not to hold us and/or any of our group entities or affiliates, their respective directors, officers, employees, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or indirect or remote that they may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of this App and Scheme.
Miscellaneous
Force Majeure: This Scheme is subject to force majeure circumstances including without limitation, floods, natural disasters, war, acts of terror, political unrests, technical snags, acts of God, changes of laws or any circumstances beyond our reasonable control. We shall not be liable for any delay or adverse effect caused to this Scheme thereunder as a result of a Force Majeure Event.
Severability: Each part of this disclaimer is severable from the other parts.
Non-waiver: Failure by us to enforce any of our rights at any stage does not constitute a waiver of those rights. Further, we may assign any of our rights within the Scheme period to any party without prior intimation to you.
Non-Answerability: We do not make any commitment, express or implied to respond to any of your feedback, suggestion and/or queries.
Final Decision: In case there is any discrepancy or dispute regarding the App or Scheme, our decision shall be final and neither we nor any third party shall have any liability towards you. No queries/complaints whatsoever in this regard shall be entertained.
Mediation: Any dispute arising out of this Scheme shall first be attempted to be resolved amicably through negotiations. In the event, amicable settlement fails, then the dispute shall be referred to Mediation. The venue of Mediation shall be Delhi only.
Governing Laws: This App, Scheme and T&C shall be governed by and interpreted in accordance with the laws in India.
Jurisdiction: In the event of any dispute necessitating adjudications by courts, the courts in Delhi, India alone shall have exclusive jurisdiction.
